1. Acceptance of Terms

By booking or participating in any tour or charter with Out to Lunch Sailing (“we”, “our”, “us”), you agree to be bound by these Terms & Conditions.

2. Bookings and Payment

All bookings are processed through our third-party booking provider, FareHarbor.

  • Full payment may be required at the time of booking
  • Prices are listed in Canadian dollars unless otherwise stated
  • A booking is not confirmed until payment is received and confirmation is issued

3. Cancellation and Refund Policy

Daily Tours:

  • Cancellations made 24 hours or more in advance: full refund
  • Cancellations within 24 hours: non-refundable

Private Charters:

  • Cancellations made 72 hours or more in advance: full refund
  • Cancellations within 72 hours: non-refundable

No-Shows:

  • Guests who do not arrive for their scheduled departure will be charged the full booking amount.

4. Weather and Safety

All departures are subject to weather, sea, and safety conditions.

  • We reserve the right to delay, modify, or cancel any trip for safety reasons
  • If we cancel due to weather or operational reasons, guests will be offered:
    • A full refund, or
    • The option to reschedule

Safety is our top priority at all times.

5. Participation Requirements

  • Guests must follow all instructions provided by the captain and crew
  • We reserve the right to refuse boarding or remove any guest whose behavior is unsafe, disruptive, or inappropriate, without refund
  • Guests should be in reasonable physical condition to board and move safely on a vessel

6. Alcohol and Conduct

  • Alcohol may be served onboard in accordance with applicable laws and licensing
  • Guests must consume alcohol responsibly
  • Intoxicated or unsafe behavior will not be tolerated and may result in removal from the vessel without refund

7. Assumption of Risk

By participating in a sailing experience, guests acknowledge that:

  • Marine activities involve inherent risks, including but not limited to movement of the vessel, weather conditions, and boarding/disembarking
  • Participation is voluntary and at the guest’s own risk

Guests may be required to sign a waiver prior to departure.

8. Liability Limitation

To the fullest extent permitted by law:

  • Out to Lunch Sailing is not liable for any personal injury, loss, damage, or delay arising from participation in our tours or charters, except where caused by proven negligence
  • We are not responsible for loss or damage to personal belongings

9. Arrival and Departure

  • Guests are required to arrive at least 15 minutes prior to departure
  • Late arrivals may not be accommodated and may be treated as no-shows

10. Changes to Bookings

  • Requests to change a booking are subject to availability
  • Changes may not be possible within the cancellation window

11. Photography and Media

We may take photographs or videos during tours for promotional purposes.

  • By participating, you consent to the use of such media unless you notify us otherwise prior to departure

12. Governing Law

These Terms & Conditions are governed by the laws of the Province of New Brunswick and applicable Canadian laws.

Vessel Certification and Regulatory Compliance
Out to Lunch Sailing operates under the regulatory authority of Transport Canada in accordance with the Canada Shipping Act, 2001 and associated Small Vessel Regulations.

The vessel is classified as a passenger-carrying vessel of not more than 15 gross tonnage carrying no more than 12 passengers and is required to comply with applicable construction, safety equipment, and operational standards.

All operations are conducted within sheltered waters as defined in Schedule 1 of the Small Vessel Regulations.
